Shellaro Software License

Shellaro is published under the DvirLabs brand. DvirLabs is a brand and project name used by Dvir Horev; it is not a company or other legal entity. The licensor under this license is Dvir Horev ("I", "me", "my").

Release-ready draft. It has not yet received professional legal review; the wording may change before the stable 1.0 release.

In short: Shellaro is free to download and use, at home and at work, including by companies for their internal use. Get it from the official Shellaro channels: passing the installer on to others, mirroring or repackaging it, or putting it in a software catalog needs my permission. It is closed source: you may not modify, resell or reverse engineer it. It comes without warranty, and you are responsible for what you do with it on your servers and infrastructure. The rest of this document is the actual license; this summary does not replace it.

1. Definitions

"Software" means Shellaro Desktop: the application, its installer and updates, the extensions, Command Packs, labs and other content bundled with it by me (unless such content states a different license), its documentation, and any copies of these, but not the Third-Party Components, the Third-Party Content, or the SDK and CLI (section 5).
"Third-Party Components" means the software of others included in Shellaro, listed in the third-party notices (THIRD-PARTY-NOTICES.txt, shipped with the Software and shown in Settings > Help & About > Third-party notices).
"Third-Party Content" means extensions, Command Packs, labs, runbooks, scripts and other content that is not made by me, whether you obtain it through the Marketplace, a source you add, a file, or otherwise.
"Official Channels" means the official Shellaro website, the official Shellaro release pages, the update mechanism built into the Software using the official update server, and any other channel I expressly authorize, either in writing or by publishing it on the official website as an official distribution channel (for example, a listing in a package manager such as winget that I publish or approve).
"You" means the person or organization using the Software. If you accept this license on behalf of an organization, "you" includes that organization.

2. License grant

Subject to this license, I grant you a free, non-exclusive, non-transferable, non-sublicensable, worldwide license to:

download the Software from an Official Channel;
install and use it on any number of devices that you own or control (an organization's own administrators may perform these installations on the organization's devices);
use it for personal, professional and commercial purposes, including use by companies and other organizations for their internal business purposes, without any fee or separate commercial license; and
make copies of the Software only as reasonably necessary to install, use and back it up as permitted here.

This license grants use, not distribution. Each person or organization that wants Shellaro obtains it from an Official Channel. Distribution of the Software by anyone else is allowed only when I have expressly authorized it (section 3.1).

The Software is licensed, not sold. No fee, license key, activation or account is required.

3. Restrictions

Except as expressly permitted in this license, and except to the extent such a restriction is prohibited by applicable law, you may not:

redistribute the Software or make it available to anyone else, without my express authorization or other than through an Official Channel. This includes: sharing, publishing, uploading or mirroring the installer or the application; repackaging it; bundling it with other software or devices; offering it through a software center, package manager, internal software catalog, network share or similar deployment system; and giving copies of the installer to third parties or to an organization's employees or contractors for them to install. Pointing people to an Official Channel is always allowed;
sell, sublicense, rent, lease, lend or commercially redistribute the Software, or offer it as part of a paid product or service that delivers copies of it;
copy the Software, except as reasonably necessary for the installation, use and backup permitted in section 2;
modify, adapt, translate or create derivative works of the Software;
reverse engineer, decompile or disassemble the Software, or otherwise attempt to derive its source code;
circumvent, disable or interfere with security or technical protection features of the Software, including the verification of updates and of extension packages;
use the Software or any part of it to build or distribute an unauthorized derivative, competing copy, or product based on it; or
remove, alter or obscure copyright, trademark or license notices in the Software.

Where applicable law gives you a right that one of these restrictions would otherwise limit (for example, a right to decompile for interoperability), you may exercise that right only to the extent and under the conditions that law allows.

4. Third-Party Components

The Third-Party Components are owned by their respective authors and are licensed to you under their own licenses, reproduced in the third-party notices. I do not claim ownership of them. Nothing in this license limits any right you have under those licenses, and where a Third-Party Component's license grants you rights that conflict with this license, that license governs your use of that component.

5. Third-Party Content, SDK and CLI, first-party content

The Software can install and run Third-Party Content. Third-Party Content belongs to its authors and is subject to its own license and terms; I do not own it and this license does not license it to you. I do not review, endorse or warrant Third-Party Content, and you install and run it at your own discretion. Shellaro shows the permissions an extension asks for before you install it, but that is not a guarantee of its safety or behavior.

Content you create with the Software (your sessions, runbooks, notes, extensions, Command Packs, labs and other files) belongs to you or your licensors.

SDK and CLI. The Shellaro Extension SDK (@shellaro/extension-sdk, including its public extension format definitions) and the Shellaro CLI (@shellaro/cli) are not covered by this license: they are licensed under the MIT License stated in their own LICENSE files, so that anyone can build extensions, Command Packs and labs. They contain only public developer material (API types, extension schemas and their validators, templates and tooling). The MIT License of the SDK and CLI does not extend to the Software, even where the Software includes the SDK's public format definitions. Extensions you build with them are yours.

First-party content (extensions, Command Packs and labs published by me) is part of the Software and licensed under this license, unless that content states a different license.

6. Your responsibility for your systems

Shellaro is a tool for working on real computers and infrastructure. It can run commands on remote servers, send the same command to several servers at once (MultiExec), run runbooks and Command Packs, transfer, edit, overwrite and delete remote files, open network tunnels, and act on Kubernetes clusters. Labs deliberately create broken workloads on the target you choose.

You are solely responsible for:

having the authorization required to access and change the systems you connect to;
reviewing commands, scripts, runbooks, packs, labs and extensions before you run them, and the targets they run on;
backups, and the consequences of the actions you take with the Software.

Command safety warnings, environment labels, confirmations and similar features are a best-effort aid. They do not detect every dangerous action and are not a security boundary.

7. Updates

I may provide updates. The Software can check for, download and offer updates from the official update server; checks can be turned off in Settings > Updates. Updates are licensed under the license that accompanies them, or under this license if none does. I am not obliged to provide updates, support or any particular feature, and I may stop providing the Software or updates at any time.

8. Privacy

How the Software handles data is described in PRIVACY.md (also on the official website). The Software contains no telemetry.

9. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT. I DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED, THAT IT WILL WORK IN YOUR ENVIRONMENT OR WITH YOUR SYSTEMS, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OR CORRUPTION OF FILES OR CONFIGURATIONS, DOWNTIME, DISRUPTION OR DAMAGE TO SERVERS, CLUSTERS, NETWORKS OR OTHER SYSTEMS, BUSINESS INTERRUPTION, LOST PROFITS, REVENUE, GOODWILL OR SAVINGS, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THIS LICENSE OR THE USE OR MISUSE OF, OR INABILITY TO USE, THE SOFTWARE OR ANY THIRD-PARTY CONTENT, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND
MY TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID ME FOR THE SOFTWARE (WHICH, FOR THIS FREE SOFTWARE, IS ZERO), OR, WHERE APPLICABLE LAW DOES NOT ALLOW THAT, THE LOWEST AMOUNT IT ALLOWS.

11. Rights that cannot be limited

Nothing in this license excludes or limits any liability, warranty or right that cannot be excluded or limited under applicable law, including mandatory consumer rights, or liability for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by negligence, to the extent such liability cannot be limited. Where the law of your country does not allow a disclaimer or limitation in this license, it applies to the greatest extent that law allows.

12. Termination

This license applies until it ends. It ends automatically if you breach it (except where applicable law requires notice and an opportunity to cure, in which case after those). You may end it at any time by uninstalling the Software and deleting your copies. When it ends, you must stop using the Software and delete your copies. Sections 4, 5, 6 and 9 to 15 survive.

13. Compliance with laws

You are responsible for using the Software in compliance with the laws and regulations that apply to you, including export control and sanctions laws, and the terms of the systems and services you connect to.

14. Trademarks

"Shellaro", "DvirLabs" and their logos are names used by me to identify the Software and its publisher. This license grants no right to use them, except to refer to the Software accurately.

15. General

This license is the entire agreement between you and me about the Software and replaces any earlier statements about it. If a provision is held unenforceable, it applies to the extent enforceable and the rest of the license remains in effect. My failure to enforce a provision is not a waiver. You may not transfer this license without my written consent; I may transfer it. A later version of the Software may come with an updated license, which then applies to that version.
